This Viewpoint analyzes policies for covering GLP-1 receptor agonist drugs for obesity treatment across 13 high-income countries. It identifies four key lessons for developing coverage policies: 1) using up-to-date cost-effectiveness analyses that incorporate new evidence of benefits, 2) negotiating lower prices while preserving innovation incentives, 3) prioritizing coverage for specific populations rather than issuing blanket denials, and 4) treating obesity medications similarly to high-cost drugs for other conditions. This article evaluates seven strategies for managing the high costs of GLP-1 receptor agonists (GLP-1RAs) like semaglutide and tirzepatide for weight management: complete exclusion of coverage, annual cost increase caps, lifetime cost caps, tiered access, formulary reevaluation, subscription payment models, and patent reform. The authors assess each strategy against three ethical objectives: benefiting people and preventing harm, showing equal moral concern, and mitigating disadvantage. Complete coverage exclusions, arbitrary reimbursement caps, and lifetime limits are deemed unethical as they fail to meet (...) these objectives. Tiering access based on relative benefit is considered justifiable, though current implementation often unfairly favors diabetes over obesity treatment. The authors recommend formulary reevaluation as the most ethical approach for smaller health plans, allowing them to prioritize more cost-effective treatments. For larger payers with market power and for governments, subscription payment models and patent reforms are potentially ethical solutions if implemented sustainably. The authors conclude that health plans should avoid ad hoc restrictions on GLP-1RAs in favor of comprehensive policy reforms that ensure sustainable access to these and future breakthrough treatments. This commentary examines the role of sustainability in the latest draft of the WHO pandemic accord, highlighting its notable absence from the official list of guiding principles despite being mentioned frequently throughout the text. It argues that sustainability should be explicitly acknowledged as a core principle and given a clear definition tailored to pandemic preparedness, and proposes defining sustainability as ensuring that immediate emergency responses don't compromise future pandemic preparedness and response capabilities. Including sustainability as a guiding principle would serve (...) two key purposes: validating the relevance of ethical principles in the accord's provisions and emphasizing the importance of long-term planning in pandemic preparedness. The commentary notes that while humans naturally discount future consequences, sustainable pandemic planning requires considering impacts beyond the next pandemic. It recommends coupling any reforms, such as intellectual property changes, with alternative innovation incentives to maintain a balanced approach to pandemic preparedness and response. (shrink)

Initial vaccine allocations for the coronavirus disease 2019 (COVID-19) will be limited. It is crucial to assess the ethical values associated with different methods of allocation, as well as important scientific and practical questions. This Viewpoint identifies three ethical values, benefiting people and limiting harm; prioritizing disadvantaged populations; and equal concern for all. It then explains why these values support prioritizing three groups: health care workers; other essential workers and people in high-transmission settings; and people with medical vulnerabilities associated with (...) poorer COVID-19 outcomes. In contrast, two other groups, people over 65 without medical vulnerabilities and participants in clinical research, present more complex ethical questions. This prioritization also encompasses valuing direct benefits to vaccinated individuals, indirect benefits to individuals protected from spread of infection, and indirect health and socioeconomic benefits to those protected from harm as health system and societal functioning improve. Vaccine allocation that recognizes important ethical values and avoids arbitrariness, waste, and corruption can ensure that the distribution of a COVID-19 vaccine is both fair and perceived as fair. According to the subjective view of lying, speakers can lie by asserting a true proposition, as long as they believe this proposition to be false. This view contrasts with the objective view, according to which lying requires the actual falsity of the proposition asserted. The aim of this paper is to draw attention to pairs of assertions that differ only in intuitively redundant content and to show that such pairs of assertions are a reason to favour the subjective view of (...) lying over the objective one. Controversy persists over the ethics of compensating research participants and providing posttrial benefits to communities in developing countries. Little is known about residents' views on these subjects. In this study, interviews about compensation and posttrial benefits from a hypothetical HIV vaccine trial were conducted in Uganda’s Rakai District. Most respondents said researchers owed the community posttrial benefits and research compensation, but opinions differed as to what these should be. Debates about posttrial benefits and compensation rarely include residents' views like these, (...) but future ones should. (shrink)

The 2010 Patient Protection and Affordable Care Act was designed to increase health insurance coverage in the United States. Its most controversial feature is the requirement that US residents purchase health insurance. Opponents of the mandate argue that requiring people to contribute to the collective good is inconsistent with respect for individual liberty. Rather than appeal to the collective good, this Viewpoint argues for a duty to buy health insurance based on the moral duty individuals have to reduce certain burdens (...) they pose on others. When some people have a duty to rescue, others may have a duty to take rescue precautions, in this case, to purchase health insurance to cover acute and emergency care needs. We argue that the ethical case for instituting vaccine benefit programs is justified by 2 widely recognized values: (1) reducing overall harm from COVID-19 and (2) protecting disadvantaged individuals. We then explain why they do not coerce, exploit, wrongfully distort decision-making, corrupt vaccination's moral significance, wrong those who have already been vaccinated, or destroy willingness to become vaccinated. However, their cost impacts and their effects on public perception of vaccines should be evaluated.

Frequent public uproar over forms of data science that rely on information about people demonstrates the challenges of defining and demonstrating trustworthy digital data research practices. This paper reviews problems of trustworthiness in what we term pervasive data research: scholarship that relies on the rich information generated about people through digital interaction. We highlight the entwined problems of participant unawareness of such research and the relationship of pervasive data research to corporate datafication and surveillance. We suggest a way forward by (...) drawing from the history of a different methodological approach in which researchers have struggled with trustworthy practice: ethnography. To grapple with the colonial legacy of their methods, ethnographers have developed analytic lenses and researcher practices that foreground relations of awareness and power. These lenses are inspiring but also challenging for pervasive data research, given the flattening of contexts inherent in digital data collection. We propose ways that pervasive data researchers can incorporate reflection on awareness and power within their research to support the development of trustworthy data science. (shrink)

It has become increasingly difficult for individuals to exercise meaningful control over the personal data they disclose to companies or to understand and track the ways in which that data is exchanged and used. These developments have led to an emerging consensus that existing privacy and data protection laws offer individuals insufficient protections against harms stemming from current data practices. However, an effective and ethically justified way forward remains elusive. To inform policy in this area, we propose the Ethical Data (...) Practices framework. The framework outlines six principles relevant to the collection and use of personal data—minimizing harm, fairly distributing benefits and burdens, respecting autonomy, transparency, accountability, and inclusion—and translates these principles into action-guiding practical imperatives for companies that process personal data. In addition to informing policy, the practical imperatives can be voluntarily adopted by companies to promote ethical data practices. (shrink)

Global sectors and industries are trying to anchor themselves amidst the pandemic. The study focuses on the sectors that (...) are badly hit by the outbreak and discussed the strategies and responses different countries are taking to sustain their economies. This study concludes that the vital role of Information Technology and digitization supports the economies in their fight against the pandemic and helps them sustain themselves amid crises. Objective Some researchers claim that the quality of informed consent of clinical research participants in developing countries is worse than in developed countries. To evaluate this assumption, we reviewed the available data on the quality of consent in both settings. Methods We conducted a comprehensive PubMed search, examined bibliographies and literature reviews, and consulted with international experts on informed consent in order to identify studies published from 1966 to 2010 that used quantitative methods, surveyed participants or parents of paediatric participants (...) in actual trials, assessed comprehension and/or voluntariness, and did not involve testing particular consent interventions. Forty-seven studies met these criteria. We compared data about participant comprehension and voluntariness. The paucity of data and variation in study methodology limit comparison and preclude statistical aggregation of the data. Results and Discussion This review shows that the assertion that informed consent is worse in developing countries than in developed countries is a simplification of a complex picture. Despite the limitations of comparison, the data suggest that: (1) comprehension of study information varies among participants in both developed and developing countries, and comprehension of randomisation and placebo controlled designs is poorer than comprehension of other aspects of trials in both settings; and (2) participants in developing countries appear to be less likely than those in developed countries to say they can refuse participation in or withdraw from a trial, and are more likely to worry about the consequences of refusal or withdrawal. Coronavirus disease 2019 can lead to respiratory failure. Some patients require extracorporeal membrane oxygenation support. During the current pandemic, health care resources in some cities have been overwhelmed, and doctors have faced complex decisions about resource allocation. We present a case in which a pediatric hospital caring for both children and adults seeks to establish guidelines for the use of extracorporeal membrane oxygenation if there are not enough resources to treat every patient. AUTOCOMPOSIÇÃO DE CONFLITOS: DA CULTURA DE LITIGÂNCIA À SOLUÇÃO CONSENSUAL.

Como podemos observar na sociedade contemporânea, as relações de poder estão cada vez mais disseminadas por todos os lados, seja nas relações familiares, num grupo de amigos, numa instituição, numa empresa, em cargos públicos, etc, e essas relações podem-se caracterizar de forma simples (entre dois indivíduos) ou numa esfera mais complexa (empresa, cidade ou país). E cada uma dessas relações têm em comum o fato de servirem como meio de influência na consulta alheia. Na esfera social, são números demasiados de (...) exemplos ou formas de exercício do poder, todavia podemos destacar as que estão no pódio social, e que são as formas de poder predominantes, são eles: o poder econômico, o poder ideológico e o poder político. O primeiro baseia-se na posse de bens materiais, como meios de produção, à exemplo citado anteriormente o poder do patrão sobre seus empregados, o patrão exerce uma ordem (poder) que, caso não cumprida ou não realizada, o empregado pode até perder seu emprego, por isso o proletário é submetido ao patrão que submete suas leis e vontades sobre os empregados. O segundo exemplo, o poder ideológico, serve-se das ideias ou simplesmente de informações para influenciar, de forma direta ou indireta, a conduta e os princípios dos indivíduos, ou influenciar seus comportamentos sobre algo determinado, à exemplo dessa influência, citemos o papel hegemônico de determinados meios de comunicação sobre as pessoas, o poder que a mídia exerce sobre o comportamento humano é gigantesco. Como exemplo da inclusão mídia na mente humana, podemos citar uma família que se alimentou e se serve satisfeita após a refeição, porém ao assistir um programa e em seu comercial estiver passando a propaganda de um produto alimentício, é da natureza humana sentir fome novamente, e essas famílias irem atrás do produto na própria casa, ou em supermercados, restaurantes, etc, para conseguir o produto. O terceiro e último exemplo, o poder político, goza de ferramentas e variadas técnicas para alcançar a influência na conduta alheia, isto é, tentar mudar uma opinião já formada dos cidadãos sobre determinados assuntos, à exemplo o poder de convencimento de partidos políticos e seus candidatos sobre o eleitorado durante um pleito político ou eleições municipais, estaduais ou federais. Após essa iniciação sobre as três formas de exercício do poder, vamos destrinchar cada uma delas, facilitando a compreensão e os seus respectivos papéis no âmbito social. (shrink)

Global health is at a crossroads. The 2030 Agenda for Sustainable Development has come with ambitious targets for health and health services worldwide. To reach these targets, many more billions of dollars need to be spent on health. However, development assistance for health has plateaued and domestic funding on health in most countries is growing at rates too low to close the financing gap. National and international decision-makers face tough choices about how scarce health care resources should be spent. Should (...) additional funds be spent on primary prevention of stroke, treating childhood cancer, or expanding treatment for HIV/AIDS? Should health coverage decisions take into account the effects of illness on productivity, household finances, and children's educational attainment, or just focus on health outcomes? Does age matter for priority setting or should it be ignored? Are health gains far in the future less important than gains in the present? Should higher priority be given to people who are sicker or poorer? Global Health Priority-Setting provides a framework for how to think about evidence-based priority-setting in health. Over 18 chapters, ethicists, philosophers, economists, policy-makers, and clinicians from around the world assess the state of current practice in national and global priority setting, describe new tools and methodologies to address establishing global health priorities, and tackle the most important ethical questions that decision-makers must consider in allocating health resources. In our study, we examine the association between hedge fund activism and a target firm’s corporate social responsibility (CSR) activities and whether activists can promote socially responsible investments while upholding shareholders’ interests. Using different matched samples, we find a strong positive association between the target firm’s CSR in the year before it is targeted by activists and its probability of being targeted by a hedge fund. Classifying hedge fund activists into socially and non-socially responsible funds based on their objectives, we (...) find that both give similar level of consideration to a firm’s CSR activities when initiating campaigns. Similar to DesJardine and Durand (DesJardine and Durand, Strategic Management Journal 41:1054–1082, 2020), we demonstrate that hedge funds have, on average, a negative impact on target firms’ CSR in the years following the initial investments. Complementary to DesJardine and Durand (DesJardine and Durand, Strategic Management Journal 41:1054–1082, 2020), we compare the two types of hedge funds and find an asymmetric effect of the hedge funds’ campaigns. Socially responsible hedge fund campaigns are associated with a large _increase_ in their target’s CSR, whereas non-socially responsible hedge funds _decrease_ this measure in their target. Finally, we find that target firms exhibit a long-term improvement in future stock returns and profitability. These findings provide evidence that certain types of activists, such as socially responsible funds, promote both _stakeholder_ and _shareholders’_ long-term interests. (shrink)

Resumen El sentimiento trágico de la vida fue una de las grandes aportaciones filosófico-religiosas de don Miguel de Unamuno. Si es cierto que, al lado de su concepción trágica de la existencia, se yuxtaponen conceptos tan fundamentales y decisivos como los de conatus essendi, lucha por la vida, fe y Dios, en el presente estudio nos ceñiremos a la relación polémica y angustiada que la pistis mantiene con la gnosis o, si se quiere, que la fe mantiene con la razón (...) en cuanto al destino último de las conciencias individuales. Con ello intentaremos poner de relieve los rasgos más característicos y simbólicos de la existencia humana así como la conceptualizó Unamuno en su época finisecular decimonónica, cuando el positivismo y la fenomenología impugnaban la metafísica como rama legítima del conocimiento.The Tragic Sense of Life was one of Miguel de Unamuno’s great philosophical-religious contributions. It is true that next to his tragic conception of existence we find juxtaposed concepts as fundamental and decisive as those of conatus essendi, life struggle, faith and God, but, while admitting these, in the present study we address only the polemical and anguished relation that pistis has with gnosis, or in other words, that faith has with reason, in relation to the ultimate fate of individual consciences. Thus we attempt to highlight the most characteristic and symbolic traits of human existence as conceptualized by Unamuno at the turn of the 19th to the 20th century, when positivism and phenomenology seemed to challenge metaphysics as a legitimate branch of knowledge. With the world grappling with continued spread of monkeypox internationally, vaccines play a crucial role in mitigating the harms from infection and preventing spread. However, countries with the greatest need - particularly historically endemic countries with the highest monkeypox case-fatality rates - are not able to acquire scarce vaccines. This is unjust, and requires rectification through equitable allocation of vaccines globally. We propose applying the Fair Priority Model for such allocation, which emphasizes three key principles: 1) preventing harm; 2) prioritizing (...) the disadvantaged; and 3) treating people with equal moral concern. Post-exposure prophylaxis (PEPV) has the most potential to mitigate harm, and so ensuring countries have sufficient supply for PEPV should be the first priority. And historically endemic countries, which face disadvantages that compound potential harms from monkeypox, should be the first recipients of such vaccines. Once sufficient supply is allocated for countries to apply PEPV, global allocation could move on to pre-exposure prophylaxis (PrEP), again prioritizing historically endemic countries first before distribution to the rest of the global community, based on projected number of cases and vulnerability to harm. Current challenges in medical practice, research, and administration demand physicians who are familiar with bioethics, health law, and health economics. Curriculum directors at American Association of Medical Colleges-affiliated medical schools were sent confidential surveys requesting the number of required hours of the above subjects and the years in which they were taught, as well as instructor names. The number of relevant publications since 1990 for each named instructor was assessed by a PubMed search.In sum, teaching in all three subjects combined (...) comprises less than two percent of the total hours in the American medical curriculum, and most instructors have not recently published articles in the fields they teach. This suggests that medical schools should reevaluate their curricula and instructors in bioethics, health law, and health economics. (shrink)

RESUMEN La reconstrucción realizada en el presente artículo parte de la hipótesis de que pueden diferenciarse dos tipos de objeciones schützianas al texto canónico de Husserl, a saber: inmanentes y fundamentales. Las primeras remarcan las dificultades subyacentes en los pasos tomados por Husserl para resolver el problema de la intersubjetividad trascendental, mientras que las segundas cuestionan la pertinencia filosófica del problema mismo. ABSTRACT The hypothesis underlying the reconstruction set forth in the article is that Schütz's objections to Husserl's canonical text (...) are of two types: immanent and fundamental. The former underline the difficulties inherent to Husserl's steps in trying to solve the problem of transcendental intersubjectivity, while the latter question the philosophical pertinence of the issue itself. En el presente estudio procuraremos determinar los dos ejes de la ética unamuniana, que, al estar vinculados con el dualismo antropológico “yo-íntimo” y “yo-público”, podríamos condensar en los conceptos de “bondad” y “obra”. Unamuno, en cuanto heredero del romanticismo y del existencialismo, consideró que lo fundamental, en términos axiológicos, era que los individuos aprendiesen a “ser buenos” y no a “hacer [meramente] el bien”, ya que solo a través de la pureza del sentir, es decir, de la “bondad ética”, el (...) “sujeto moral” podría constituirse como una “persona” a través de sus “obras”. En este aspecto, la relación de la ética unamuniana con los “oficios” es decisiva, ya que cada “individuo” a través de su “profesión” está llamado a formar su “persona”. (shrink)

El artículo tiene como objetivo presentar y valorar críticamente la propuesta de John Rogers Searle sobre la libertad. Para esto, en un primer momento mostraremos que para él la libertad debe entenderse desde la perspectiva de la primera persona, es decir desde la experiencia subjetiva. Desde allí establece que la libertad se expresa en el llamado fenómeno de la brecha, es decir, en el salto que experimentamos entre la causa y el efecto en el proceso de realización de una acción. (...) Este salto se manifiesta en los actos llevados a cabo por razones independientes del deseo, como puede observarse en el altruismo fuerte. En un segundo momento, dedicado a la valoración crítica de la propuesta de Searle, consideramos la importancia de la perspectiva de primera persona para entender la libertad. Luego mostramos que una noción analógica de causa permite entender mejor el acto libre, como así también evitar el dualismo y el reduccionismo materialista. Esta visión, propia de la tradición aristotélico-tomista y que podríamos denominar de tercera persona, debe complementarse con una reflexión desde la interioridad, como realiza Michele Federico Sciacca. Concluimos luego con una breve reflexión sobre el tema del vínculo interdisciplinar como forma de entender las temáticas antropológicas. (shrink)

This paper examines the effects of a decrease in auditor litigation risk in a setting that isolates a change in auditor litigation risk from changes in auditor reputation. _StoneRidge Investment Partners v. Scientific Atlanta_ is a 2008 U.S. Supreme Court ruling that restricted secondary actor liability in class action suits, resulting in a decrease in class actions that listed auditors as defendants. We document that the _StoneRidge_ decision is associated with a negative CAR for clients of Big 4 auditors and (...) industry specialist auditors, in particular those associated with high-litigation risk, low cash, and past incidences of modified going concern opinions. These findings are consistent with investor perception of lower potential payoffs from secondary defendants in class action suits, in particular auditors, following the _StoneRidge_ decision. We also document that auditors are more (less) likely to accept (reject) risky clients and charge lower audit fees to risky clients after _StoneRidge_, consistent with a decrease in auditor litigation risk that increases auditor risk tolerance. Finally, we provide evidence that audit firms issue fewer going concern opinions following _StoneRidge_, consistent with a decrease in litigation risk leading to lower audit quality_._ Our results are relevant to policy makers as they consider the disciplinary role of litigation on audit markets. The manuscript not only lays out the complex array of realms in the Buddhist universe but also ventures into a number of esoteric and little-understood aspects of the Therav da cosmological system and its inhabitants. By presenting translations and narration of much of the manuscript's text and sharing his careful analysis of its vivid illustrations, the author uncovers fascinating details (...) of the Therav da Buddhist cosmos. Detailed color and black-and-white illustrations, including a complete reduced-scale reproduction of the manuscript, help clarify and explain the complex, segmented Buddhist cosmology. (shrink)

Este artículo se propone argumentar por qué la reivindicación o el relego del término campesino constituye una apuesta política por excelencia. En esta dirección, se sostiene que la ambigüedad de aquella categoría, lejos de ser una debilidad, puede tornarse una potencia en la medida que el discurso sobre la diferencia específica sea desplazado por la problematización de la (des)igualdad. En efecto, el interrogante sobre qué es lo que distingue a un campesino cede lugar a la pregunta ¿qué relaciones sociales son (...) puestas en cuestión o reinventadas a partir de la identificación como tal? Para ello, la reflexión teórica adopta un anclaje empírico en el surgimiento del Movimiento Campesino de Santiago del Estero (MOCASE), el cual, pese a los múltiples conflictos y divisiones internas, tiene en común haber acuñado la categoría campesino en un sentido positivo, en el marco de la disputa por la tierra. Cabe aclarar que no es la intención explicitar presuntos núcleos duros de la identidad; tampoco concebirla como etapa anterior o posterior de la acción colectiva, sino examinarla como un proceso dialógico. Asimismo, se aborda el lugar de lo campesino en Argentina y su tensión con el concepto de agricultura familiar. (shrink)

El presente estudio intenta poner de relieve la posición filosófica de don Miguel frente a la “ciencia” y la “religión”. El insigne rector salmantino, al partir del hecho de que la “ciencia” no puede satisfacer las últimas inquietudes y aspiraciones vitales de la existencia humana, presentó la “religión” como único movimiento espiritual capaz de otorgar un sentido ultraterreno al hombre, irremediablemente abocado a la muerte terrenal. Su tesis podría ser condensada en la siguiente proposición: ninguna “sociedad perfecta”, sea entendida como (...) la de Bebel o la de Kropotkine, puede ser una medicina para la muerte. Precisamente, por ello, justificó la existencia y sentido de la “religión” como respuesta más anhelada al tremendo problema de la precariedad y de la finitud de la existencia humana. (shrink)

Las organizaciones sin fines de lucro han sufrido grandes cambios. Dejó de ser un sector empobrecido, donde se recibían como donaciones aquel dinero que les sobraba a los grandes empresarios, y donde sólo tenían cabida las personas voluntarias. Hoy en día es un sector marcado por el trabajo de personas profesionales y por ser organizaciones capaces de llenar los espacios que ha dejado el Estado sin atender. Además de ser organizaciones inteligentes, con estructuras flexibles, que les permiten responder de manera (...) ágil a los requerimientos de su entorno. Sin embargo para que el sector sin fines de lucro pueda evolucionar de manera exitosa, no sólo necesitan de la labor de sus miembros, también necesitan del compromiso del estado, las universidades y las entidades privadas. Un compromiso que se haga visible a través de alianzas de colaboración entre sí, y así de esta manera trabajar conjuntamente en el desarrollo humano y la inclusión social en Chile. (shrink)

Quarantine, isolation, social distancing, and community containment have influenced consumer behavior and contributed to the rapid development of e-commerce. In pandemic times, even those unfamiliar with the online environment have had to adapt and make acquisitions in this new manner. Hence, we focused our research on measuring the perception of consumers on how the restrictive measures imposed to limit the spread of (...) the COVID-19 virus had influenced their decision to buy a product or service from the online environment, given that purchases are highly subjective and influenced by cumulative effects of economic, social, psychological and behavioral factors. Our paper comes with additional insights from the literature. It adds empirical evidence that reveals that the number of transactions and the value per transaction increased during the COVID-19 pandemic and highlights that online purchases will continue as such even after the pandemic.
